Terms of Service

Draft — under legal review. This wording has been prepared in-house and has not yet been checked by a qualified lawyer. It describes accurately how the site works, but it is not final.

1. Who we are and what this document is

My Swing Hub is a private online community for consenting adults. It is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS], company number [COMPANY NUMBER] ("we", "us", "our").

These Terms of Service are the agreement between you and us. They apply every time you use the site. If you do not accept them, do not create an account and do not use the site.

Please also read our Privacy Policy, which explains what we do with your personal information. It forms part of this agreement.

2. Who is allowed to use My Swing Hub

You may use this site only if all of the following are true:

  • You are at least 18 years old.
  • You are old enough to view sexually themed material where you live, if that age is higher than 18.
  • You have the legal capacity to enter into this agreement.
  • You have never been convicted of a sexual offence, and you are not subject to any order or registration requirement relating to one.
  • You have not previously been removed from My Swing Hub by us.

We ask for your date of birth when you register and we ask you to confirm your age before you can see the site at all. We record the date, time, IP address and browser identification of that confirmation. This is a self-declaration: we do not verify anyone's age at sign-up, and you should not assume that any other member's stated age has been checked.

Providing a false date of birth is a serious breach of these terms and will result in immediate removal.

3. Your account

You must give us a working email address and confirm it by clicking the link we send you. Until you confirm it, your profile is not visible to anyone else, you cannot be messaged and you cannot take part in conversations.

One person or one couple, one account. Do not create an account for anyone else, and do not let anyone else use yours.

Keep your password to yourself. You are responsible for what happens under your account. Tell us straight away at [CONTACT EMAIL] if you think someone else has got into it.

Everything you put in your profile is your responsibility. Do not put anything in it that identifies another person without their agreement.

4. What this service is, and what it is not

My Swing Hub is a place to create a profile, browse other members, express interest and — where that interest is mutual — exchange messages. That is all it is.

Specifically, it is not any of the following:

  • An escort service, an introduction agency, or any kind of paid companionship. Offering or requesting money or anything of value in exchange for sexual activity is forbidden and will end your account.
  • A verified or vetted community. We do not check who members really are unless they choose to verify, and even then we check a document, not a person's character or intentions.
  • A dating guarantee. We do not promise you will meet anyone, get replies, or have any particular experience.

We are a platform. What members say to each other, and what happens if they meet, is between them.

5. Rules of conduct

You must not do any of the following, on the site or through it:

  • Involve anyone under 18 in any way. Any sexual content involving a minor will be removed, the account ended immediately and permanently, and the matter reported to the authorities. There is no warning and no appeal.
  • Upload, send or ask for images of anyone who has not agreed to it. This includes images of a former partner, and images of anyone identifiable who is not a member here.
  • Send sexually explicit messages or images to someone who has not indicated they want them.
  • Harass, threaten, stalk, intimidate or abuse anyone, or keep contacting someone who has asked you to stop.
  • Pretend to be someone else, use someone else's photographs, or misrepresent your age, gender or relationship status.
  • Offer, advertise or solicit any commercial service, including sexual services, subscriptions, cam sites or other platforms.
  • Share another member's identity, photographs, messages or any other private information outside this site. What happens here stays here.
  • Post anything unlawful, or anything that promotes hatred or violence against people because of who they are.
  • Collect information about members automatically, scrape the site, or use it to build a mailing list.
  • Try to break, overload, probe or get around the security of the site, or access any account or data that is not yours.

If you see something that breaks these rules, use the report button. Reports go to a moderator.

6. Photographs and everything else you upload

You keep ownership of everything you upload. You are not giving it away.

You do give us permission to store your content and to show it to the people you have chosen to show it to, so that the site can work at all. That permission lasts as long as your content is on the site and ends when you delete it or delete your account.

By uploading a photograph you confirm that:

  • You took it, or you have the right to use it.
  • Everyone who appears in it is over 18.
  • Everyone who appears in it has agreed to it being uploaded here.

Every photograph is held back until a moderator has looked at it. Until then only you can see it. If a photograph is rejected it is deleted from our server rather than hidden.

Photographs are re-saved when you upload them, which removes hidden information such as the GPS location recorded by phone cameras.

You choose whether a photograph is public to signed-in members or kept in a private gallery. Private galleries are visible only to members you personally grant access to, and you can take that access away again at any time.

We can remove any content that breaks these rules, and we can do it without telling you first.

7. Verifying who you are

Verification is optional. You may send us an identity document and, if you wish, proof of your address.

If you do, the file is encrypted as soon as it arrives and stored outside the website's own folders. Only a reviewer can open it, and every time one is opened that is recorded.

The file is destroyed the moment a decision is made — whether we approve it or reject it. We keep the outcome. We do not keep the document. If you delete your account, anything still waiting to be reviewed is destroyed with it.

A verified badge means we looked at a document. It is not a character reference and you should not treat it as one.

8. Messaging and consent

You can express interest in another member. A conversation opens only when that interest is returned. Nobody can message you until you have shown interest in them too.

You can block any member at any time. They are not told. Blocking stops contact in both directions.

9. Suspending and ending accounts

We may suspend or permanently end your account, remove your content, or refuse you access, if we reasonably believe you have broken these terms, or that you present a risk to other members.

Where it is appropriate and safe to do so, we will tell you why. For the most serious breaches — anything involving a minor, non-consensual imagery, or a credible threat — we will act immediately and without notice.

If you believe we have got it wrong, write to [CONTACT EMAIL] and a person will look at it again.

10. Membership and payment

At the moment every account is free and there is nothing to buy on this site.

We intend to introduce a paid "Elite" tier. When we do, we will publish its price, what it includes, how it renews and how to cancel before anyone is asked to pay. Nothing in these terms obliges you to pay for anything today.

11. Leaving

You can delete your account yourself at any time from your account settings. It takes effect immediately.

Deleting removes your profile, your photographs, your messages and the other records tied to you. It is a real deletion, not a hidden profile. Before you delete, you can download a copy of everything we hold about you.

Some things may survive deletion where we are required to keep them, or where they are no longer linked to you. Our Privacy Policy explains exactly what and why.

12. Meeting other members

This matters more here than the rest of this document.

We do not check members' identities, backgrounds or intentions. Anyone can say anything about themselves online. If you decide to meet someone:

  • Meet in a public place the first time.
  • Tell somebody you trust where you are going and who with.
  • Arrange your own transport, and keep control of how you get home.
  • Do not send money to anyone, for any reason, ever.
  • Stop if you feel uncomfortable. You never owe anyone anything.

Consent is required for everything, every time, and it can be withdrawn at any point by anyone.

Meeting other members is entirely your decision and at your own risk.

13. The site itself

We try to keep the site running and to keep your information safe, but we do not promise it will always be available, uninterrupted or free of faults.

We may change, add to or withdraw features. If we make a change that significantly reduces what you get, we will tell you.

14. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and to the fullest extent the law allows:

  • We are not responsible for the behaviour of other members, online or in person.
  • We are not responsible for the accuracy of anything a member says about themselves.
  • We are not liable for loss of profit, loss of opportunity, or any indirect or consequential loss.
  • Where we are liable, our total liability to you is limited to [LIABILITY CAP — e.g. the amount you have paid us in the twelve months before the claim, or a fixed sum if you have paid nothing].

15. If you cause us loss

If you break these terms and that causes us loss, or leads to a claim against us by someone else, you agree to cover the reasonable costs we incur as a result.

16. Changes to these terms

We may update these terms. If a change materially affects your rights we will tell you by email or on the site before it takes effect, and you will have a reasonable opportunity to close your account if you do not accept it.

Continuing to use the site after a change takes effect means you accept it.

17. Law and disputes

These terms are governed by the law of [COUNTRY]. Disputes will be dealt with by the courts of [COUNTRY].

If you are a consumer, this does not take away the protection of the law of the country you live in, and you may be able to bring a claim there.
